If the court directs that an affidavit is to be filed 12, it must be filed in the court or Division, or Office or Registry of the court or Division where the action in which it was or is to be used, is proceeding or will proceed. Where, at a hearing other than the trial, evidence is given in writing, any party may apply to the court for permission to cross-examine the person giving the evidence. That applies to the litigant in person’s own trial witness statement, if there is one, as well as to any witness statements provided by other witnesses. The jurat of an affidavit is a statement set out at the end of the document which authenticates the affidavit.
