It certainly wasn’t a copycat murder. The similarities between the two murders were, according to Professor A Busuttil, “aside from the fact that they were both apparently sexually motivated homicides of young women with post-mortem mutilations of the body with a sharp instrument” there were, “No forensically significant similarities between the injury patterns in these two victims” The Habré trial has proceeded satisfactorily to date. There have been no serious breaches of fair trial rights and the court-appointed lawyers are defending the accused competently and ensuring the adversarial nature of proceedings. Rosemary Walsh and Lorraine Fleming believe they saw someone very similar to Luke Mitchell at approximately 5:45 p.m. at Newbattle Road, a fifteen minute walk from the alleged sighting of Luke Mitchell by Ms Bryson. Corinne Mitchell was arrested on the same day, April 14th, 2004, and also charged with perverting the course of justice. These charges were later spread all over the media, however the charges never materialised (like her son, Shane, the charges were later dropped). When giving evidence, it is common practice for most witnesses in a High Court trial to be warned about the risks and penalty for perjury. This was true for Corinne Mitchell as well. The Crown didn’t proceed with perjury charges because there were NO grounds to do so. Complaining about all “manners of slurs, vitriol and downright rudeness slung her way,” you could be forgiven for thinking she was describing exactly what she had done to Luke Mitchell and his mother from 2003-2021.

The same dangerous fraudster who one of his ex boss’s exposed - along with many other people (who knew Billy Middleton, long before Sandra Lean) If she was mistaken about the direction she was driving and instead was driving from the Woodburn/Mayfield area instead, as her evidence suggests, she would get a better view of the path, however it would be nothing more than a passing glance as she drove by at 30-40MPH at best. The publication’s printed reaction to Murder in a Small Town stated, “Many – including senior police officers and Jodi’s family – are angry that the TV documentary failed to point out key facts.” But…still the horror went on, he still wouldn’t give up, he had to save face, he had to show people he was right, because the very thought of all his admirers realising and knowing he was wrong was to him worse than death. Here, the Daily Record answers the then key questions often raised by those who think Luke Mitchell should be cleared.

Donald knew Mia had some training, (not that the dog needed training), so why did he not call the expert as a witness?. After all, Luke and Luke alone with virtually no help from the dog was presented as evidence to finding Jodi. Why didn’t Joseph Jones and Alan Ovens, who were less than a three-minute walk away from Roan’s Dyke Path, where the search party started, offer to assist? Instead, they permitted an old woman and a young girl go out at night into woods/fields to look for Jodi. That doesn’t seem right.

There are many victims in the Jodi Jones murder case with Jodi Jones being the primary and most important one. Some members of Jodi’s family are victims. So are Luke Mitchell and his mother. Jane Hamilton certainly isn’t one of them. The first thing I have to say about the search party is that Luke Mitchell was the only male connected to Jodi Jones who cared enough to go out in search of her. It has always puzzled me why no males in the Jones’ family went looking for a wee girl reported missing. The investigation, like any investigation, academic or criminal, should concentrate on the evidence, first and foremost. Anyone reading this with any knowledge of criminal justice, forensics, or DNA evidence, would laugh at the above statement had the case not been so serious. This is media spin. Several people were questioned extensively by police and ruled out including most of the people mentioned in the documentary. This was another slander campaign by the police and fed to their friends in the media. The public then believed that the Mitchell’s were all guilty, making the campaign a success. Around about this time, the rumours in the Dalkeith and Edinburgh area were that Luke Mitchell was taking the blame for his brother Shane, who had a history of being mentally ill and been in Rosslynlee Psychiatric Hospital as a patient, prior to and after the murder of Jodi Jones. Again, these were lies being presented to the public by the media. We now know that it was Jodi’s brother, Joseph, who had a history of mental illness and had been a patient under the Mental Health Act, prior to the murder, after the murder, and at times just prior to the trial of Luke Mitchell. The “never been found knife” was shown to Luke Mitchell in police photographs on the 14th of August 2004. DS Craig Dobbie and Jane Hamilton should have had to take a polygraph test and asked if they fitted up Luke Mitchell while disregarding all other evidence. Please, please god, could you give me Donald as the defence opposition. He’s a smashing bloke, and very kind to me. But the reporter parrots Dalkeith CID’s first impression of Luke Mitchell sometime later at Newbattle school: “He also showed no emotion at the horrifying sight.” This was a Dalkeith CID officer’s hunch and is the sole ‘evidence’ against Luke Mitchell yet spun as ‘facts’.

DNA and forensic science have improved dramatically from 10 spikes in 2003, to 16 spikes in 2022, and the science is much more accurate. There are samples in the case, that if re-examined, could definitively prove who the murderer is. The police, because they didn’t’ find vaginal trauma or wounds which would suggest rape, couldn’t make up their minds if sex had been a motivating factor or not. The impact of COVID-19 on social welfare legal advice organisations led to a group of independent funders working in partnership with representative bodies to form an alliance for social justice by creating the Community Justice Fund (CJF). ATJF, as one of the funders, was tasked with hosting and distributing this vital funding which distributed substantial sums to several Scottish charities adversely affected by the pandemic. For more information about the CJF and other campaigns, including a list of charities who have received funding, see atjf.org.uk/community-justice-fund-grants Jodi was not sexually assaulted in any way. Mitchell’s defence team claimed DNA in the condom belonged to another man – James Falconer – but during an appeal hearing in 2008 Donald Findlay QC, who was Mitchell’s lawyer, told the judges he was dropping any further claims about James, who had already been ruled out of any involvement by detectives investigating the caseAs I’ve said, I’m absolutely convinced, there’s no two ways about it. The three witnesses (besides Luke) who gave their on the spot original statements to the police were telling the truth…the dog led Luke to the V in the wall. Following the 45-day recess, hearings resumed before the EAC. Although punctuated by commotion caused early in the day by the defendant’s supporters in the courtroom, the hearings got off to a successful start on September 7, 2015. How far can a German shepherd smell? German Shepherds have 225 million scent receptors. This makes them as one of the best breeds overall for their sense of smell, being able to detect scents over a mile away on land, up to 40 feet underground and in 80 feet of water! Records show Mark Kane was living and signing on from Newbattle Abbey College at the time of the murder of Jodi Jones. Hard evidence and several witnesses corroborate this. Many people provided statements that he had scratches on his face and was acting strange in the days after the murder. Several had made the police aware of Mark Kane living in Newbattle Abbey, despite the term being finished. However Billy Middleton states: " They then threw in a charge of sexual abuse against my wife instead but both she and her uncle proved in court it was not physically possible because we were about 60 miles apart at the time and the doctor who examined her testified that there was no physical evidence to support it.

These events are great fun and an excellent way to meet up with other members of our profession, not-for-profit organisations, students and, indeed, their dogs! They are however fundraising events, and all funds raised are distributed to Scottish charities providing legal support and services to the most vulnerable in our society. For more information, visit atjf.org.uk/legal-walks But when Shane was questioned by police on 14th April 2004, he said he had been looking at porn on the internet in his bedroom and this was not something he would have done if there had been anyone else in the house at the time. This contradicted what Luke Mitchell and his mother had told the police. As stated earlier, no one trashes your name more than someone who is afraid you will tell the truth. Witnesses Rosemary Walsh and Lorraine Fleming claimed to have seen a man who looked very similar to Luke Mitchell on Newbattle Road at approximately 5:45 p.m. Some weeks later that same publication reported on the Miscarriages of Justice of Joe Steele and Tommy Campbell {Ice Cream Wars} who were fitted up by police, spent sixteen years in prison, failed in several criminal appeal attempts, and it was now being covered without an ounce of irony.
