Description

Before the change, if you lost your claim, the defendant could not recover any legal costs (in most cases). This rule is called Qualified One-Way Costs Shifting (QOCS) and was introduced in 2013 to ensure claimants could access justice without the risk of incurring significant costs if they lost. Personal injury enquiries are handled by our partners at National Accident Helpline (a trading name of National Accident Law) who are regulated and authorised by the Solicitor Regulation Authority (SRA). Assessing the value of your claim at the outset can be complicated, particularly if you have multiple injuries. There is also a revision of the approach taken to assessing damage to reproductive organs which, previously in women, focused almost exclusively upon loss of fertility and reproductive capacity. The Judicial College recognises that injuries leading to sexual dysfunction, loss of sexual function, and associated psychological sequelae may affect both men and women. The relevant sections can be found at Sections E and F of chapter 6 and they provide more detail than in the previous edition of the guidelines.

A disabling mental injury, as confirmed by a psychiatrist, that last for more than 5 years but is not permanent.Guidelines are updated by a working party of the Judicial College (previously the Judicial Studies Board or JSB) A compensation table for personal injury claim payouts will give you an insight into how much you could be awarded for your injury if your claim is successful. The figures relate to general damages, which account for the pain, suffering or loss of amenity caused by your injuries. This applies to both physical and psychological injuries. A Guide To Self-Employed Accident At Work Claims: Our guide explores how you may be able to make a personal injury claim. The guidelines are also the first to be published following the coming into force of the Whiplash Injury Regulations 2021 on 31 May 2021 and contain “new guidance in relation to the tariff-based awards for general damages under the Civil Liability Act 2018.” It is noted, however, that how this will operate in practice in claims involving a tariff award and another injury will need to be determined by the Courts in due course.

Special damages are awarded for any financial losses and expenses you have incurred as a result of your injury. The figures in the latest edition reflect the 6.56% increase in RPI since the 15th edition and are given as neatly rounded figures. Where there have been no recent decisions in relation to specific types of injury, the inflation uplift may be the only discernible change. The Guidelines reflect inflationary changes, any new decisions on quantum and any changes in policy. Therefore, in each subsequent edition, the figures will increase from time to time. As there has been two years between the publication of the 13 th and the 14 th edition, the increases will reflect the changes over this two year period. It also continues to include an additional column of figures indicating the 10% uplift in general damages, this was outlined in the Court of Appeal case of Simmons v Castle 2012 . The 10% uplift is included to reflect government reforms which meant that a success fee was no longer recoverable from the third party by the Claimant Solicitors .

The Judicial College produces a book called the Guidelines for the Assessment of General Damages in Personal Injury Cases, which is published by Oxford University Press. As of April 2022 there have been 16 editions of this book. All judges hearing cases involving personal injury automatically receive a copy of this book. Payouts for road traffic injuries may be lower if the at-fault driver can't be identified or is uninsured. These claims are usually handled by the Motor Insurers Bureau (MIB), which may use a different tariff scale for compensation. Average compensation payouts can give a very rough idea of what you could receive, but average amounts can also be misleading. The money you will receive following a successful injury claim will depend on your specific circumstances. The other major change between the 14th edition and the 15th edition of the Judicial College Guidelines is an across the board increase in the suggested range of damages by approximately 7%. This increase is slightly above the rate of inflation in the period since the 14th edition was published, which was approximately 5.7% (1). Claimants and defendants will need to be mindful that settlement offers made for general damages under the 14th edition of the Judicial College Guidelines have effectively been reduced by the introduction of the 15th edition. In particular, defendants in Stage 3 hearings under the Pre-Action Protocol for low value personal injury claims in road traffic accidents should review the protocol offers made by claimants as such offers now have increased chances of being beaten or matched and bringing Part 36 consequences to bear. The Compendium is intended to replace all of the guidance previously provided by the Judicial College and its predecessor the Judicial Studies Board namely: the ‘Specimen Directions to the Jury’ in the Crown Court Bench Book published in March 2010; the Companion to the Bench Book published in October 2011; and part II of the Companion, dealing with sentencing, published in January 2013. This Compendium seeks to combine the perceived strengths of all these previous publications, so that further reference to them is not necessary.
